The petitioner apprehends his arrest in Govindpur P.S. Case No. 46/2018, instituted for the offences punishable under Sections 341, 342, 323, 307 and 504/34 of the Indian Penal Code.

It is alleged in the written report that this petitioner assaulted the brother of the informant, namely, Amirak Yadav with Garasa on his head. It is also alleged that he assaulted the father of the informant, namely, Saudagar Yadav. Case diary has been received.

Learned Additional P.P. has opposed the prayer for bail of the petitioner and submitted that injury report of the injured

Patna High Court Cr.Misc. No.37292 of 2018 (3) dt.26-07-2018 2/2 is available wherein the doctor has found grievous injury on the head of Amirak Yadav caused by hard and blunt substance. Considering the aforesaid facts and circumstances, the anticipatory bail petition of the petitioner is rejected. The petitioner may surrender before the court below and seek regular bail, which shall be considered by the court below in accordance with law without being prejudiced by this order. The court below shall dispose of the bail petition of the petitioner preferably on the same day.
