====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 02-12-2020 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners apprehend their arrest in connection with Singhia P.S. Case No. 67/2020 registered for the offences punishable under Sections 323/324/307/341/379/504/506 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.

As per the prosecution case, on 28.05.2020 at about 08:10 hours Lalit Sahni and Govind Sahni came near the Sonsa temple for selling wine and on objection by the informant, they abused and assaulted with rod and knife and fled away. It is further alleged that later on, petitioners assembled with Govind

Patna High Court CR. MISC. No.29021 of 2020(2) dt.02-12-2020 2/2 Sada and other friends armed with Frasa, Bhala, and Lathi and assaulted the informant who received injury on his head. It is submitted on behalf of petitioners that the petitioners have been falsely implicated in this case due to village politics and also there is land dispute between the parties. It is further submitted that specific allegation of assault is against co-accused Lalit Sahni and Govind Sada and general and omnibus allegations have been levelled against these petitioners. These petitioners have no criminal antecedents as stated in paragraph No. 3 of the petition.

Considering the aforementioned facts and circumstances, the bail application of these petitioners is allowed. Let the petitioners above named be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned 1st Additional Chief Judicial Magistrate, Rosera, Samastipur, in connection with Singhia P.S. Case No. 67/2020, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Prabhat Kumar Singh, J) Saif/- U T
