JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-12-2020 Heard learned counsel for the petitioner and learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in Doriganj P.S. Case No. 72 of 2020 registered for the offence under Section 414 of the Indian Penal Code.

As per the prosecution case, one stolen motorcycle was recovered from the open verandah of the house of the petitioner.

It is submitted on behalf of petitioner that recovery has been made from the premises of the house, which is an open place accessible to the general public and there is no chit of paper in support of the fact that aforesaid motorcycle was stolen, though it was kept by this petitioner. Petitioner has got clean antecedent, as stated in paragraph - 3 of the petition.

In the event of his arrest or surrender within a period of eight weeks from the date of receipt/production of copy of this order, let the above-named petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Doriganj P.S. Case No. 72 of 2020, subject to condition as laid down under Section 438(2) of the Cr.P.C.
