This application for anticipatory bail arises out of Amnour P.S. Case No. 88 of 2018 for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 306, 354, 452, 436 and 504 of the Indian Penal Code.
There are 22 persons named in the First Information Report. It is alleged that the accused persons, armed variously, came to the informant's place and they started abusing and assaulting the informant. There is allegation against Raju Rai of having entered into the informant's house and attempted to outrage the modesty of the female members of his family. There is allegation of assault and of setting the house on fire against these petitioners.
Patna High Court CR. MISC. No.30775 of 2020(2) dt.05-01-2021 2/3 Learned counsel appearing on behalf of the petitioners has submitted that in similar circumstance other coaccused persons have been allowed anticipatory bail by this Court by various orders as mentioned in paragraph 9 of the application. There is counter case also in respect of the same occurrence alleged to have taken place on the same day and at the same time.
Considering the submissions made on behalf of the petitioners that other co-accused persons have been allowed anticipatory bail in similar circumstance, this application is allowed.
Let the petitioners above named, in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned 2nd A.C.J.M., Saran at Chapra, in Amnour P.S. Case No. 88 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their
