Heard learned counsel appearing on behalf of the petitioner and learned A.P.P. for the State.

Let the defect(s), if any, be removed within two weeks of the complete start of the physical Court in normal course.

The petitioner seeks regular bail in connection with Bathnaha P.S. Case No. 17 of 2021 for the offence punishable under Sections 376 and 420 of the Indian Penal Code. After investigation, charge sheet has been submitted under Sections 341, 323, 420 and 376/34 of the Indian Penal Code and Sections 4 and 6 of the POCSO Act and learned court below has taken cognizance against the petitioner under

Patna High Court CR. MISC. No.39690 of 2021(3) dt.30-03-2022 2/2 Sections 323, 420 and 376/34 of the Indian Penal Code and Sections 4 and 8 of the POCSO Act.

Considering the serious nature of allegation made against the petitioner, supported by the statement of the victim under Section 164 Cr.P.C., I am not inclined to enlarge the petitioner on bail at this stage.

Accordingly, the present bail application is rejected. The trial court is directed to conclude the trial expeditiously.
