2. The petitioner apprehends his arrest in a case registered for offence under Sections 70(1), 3(5) of the B.N.S., 2023 and Sections 4 / 8 of the POCSO Act.

3. It is a case of 'Gang Rape'. It is alleged that on the alleged date and time of occurrence, co-accused Nadeem alongwith three more persons took away daughter of informant aged about 14 years, made her to consume intoxicant mixed cold-drink and thereafter, all of them committed rape. The victim, in her statements recorded under Sections 181 and 183 B.N.S.S., has supported the prosecution case. During course of investigation, co-accused Md. Kallimuddin named this petitioner, as one of the person who participated in the alleged occurrence and also committed rape. The victim is minor.

4. Considering the heinous nature of offence and accusation, the prayer for anticipatory bail of petitioner is rejected.
