JUSTICE SUDHIR SINGH ORAL ORDER 02-08-2017 The present application has been filed for modification of the order dated 27.06.2016 passed in Cr.Misc.No.21148 of 2016.

On the undertaking given by the petitioner that he is ready to deposit an amount of Rs.4 lacs to the complainant within a period of six months in six equal instalments, the petitioner was granted provisional bail for a period of six months, so that the petitioner could deposit the amount in question to the complainant. It was further directed that once the said amount is deposited with the complainant, the provisional bail granted to the petitioner shall be confirmed by the court below.

The said order was passed on 27.06.2016. Now more than a year has already passed. The petitioner has not complied

Patna High Court Cr.Misc. No.46861 of 2016 (8) dt.02-08-2017 2/2 with the directions of this Court, which was made on the basis of the submissions made on his behalf.

I find no merit in the present application. The same stands dismissed.

The provisional anticipatory bail granted to the petitioner in connection with Complaint case No.1055 of 2015 (Trial No.1055 of 2016) pending in the court of C.J.M., Saran at Chapra stands cancelled on account of non-compliance of the order dated 27.06.2016 passed in Cr.Misc.No.21148 of 2016.
