JUSTICE SHIVAJI PANDEY ORAL ORDER 06-07-2018 Learned counsel for the petitioners submits that the petitioner no.1 has been arrested and, as such, this application, as against the petitioner no.1, has become infructuous. Heard learned counsel for the petitioner no.2 and learned counsel for the State.
In this case, the petitioner no.2 is apprehending his arrest in connection with Nabinagar P.S. Case No. 69 of 2018 registered for offences under sections 341, 323, 384, 504/34 of the Indian Penal Code.
An allegation has been made that the Complainant had purchased land from the petitioner no.2, when the Complainant had gone for construction over the land, the petitioner demanded Rangdari making a statement that he will be allowed to make construction over the land subject to
Patna High Court Cr.Misc. No.37587 of 2018(2) dt.06-07-2018 2/2 payment of ransom amount of Rs. 2,00,000/- or 2 decimals of land.
Learned counsel for the petitioner no.2 submits that both the parties are relative, they have settled the dispute and have also filed a joint application in the court below which has been mentioned in the impugned order itself.
Looking to the entire facts and circumstances of the case, let the petitioner no.2, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additinal Chief Judicial Magistrate, Aurangabad in connection with Nabinagar P.S. Case No. 69 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioner for investigation/interrogation, he will remain present and if he would not present himself, the privilege of grant of anticipatory bail shall be deemed to have been canceled.
