JUSTICE SANJAY PRIYA ORAL ORDER 18-01-2018 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Economic Offence Unit P.S. Case No. No. 46 of 2013 instituted for the offence under Sections 406, 420, 465, 467, 468, 471 and 120B of the Indian Penal Code.

Heard learned counsel for the petitioner, learned counsel for the Economic Offence Unit, learned counsel for the Bank and learned counsel for the State.

Learned counsel for the petitioner has submitted that the entire acts has been done by one Brij Yadav by using

Patna High Court Cr.Misc. No.50398 of 2016 (5) dt.18-01-2018 2/2 photograph and Xerox copy of I.D. of the petitioner. Learned counsel for the Bank and Economic Offence Unit have submitted that this petitioner in the name of Sunil Kumar Rai, after depositing forged NSC in the Bank, in his name, took total amount of Rs.73.57 lacs.

The Bank as well as the Economic Offence Unit after enquiry found that all the forgery has been made by this petitioner as he introduced himself as Sunil Kumar Roy whereas correct name of petitioner is Arun Kumar Pandit and in CC TV footage, the face of this petitioner has come. The counsel for the Economic Offence Unit has further submitted that during investigation, the petitioner was found absconding.

Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner stands rejected.

Petitioner may surrender before the court below and make prayer for regular bail.

The case diary is returned by the Economic Offence Unit. Let it be sent to the court below.
