The petitioners seek anticipatory bail in connection with Daudnagar PS case no. 275 of 2017 registered for the offences punishable under Sections 341, 323, 307, 3337, 338, 379, 448, 504/34 of the Indian Penal Code.
The allegation against the petitioners is assaulting and abusing the informant when they were resisted by the informant from damaging the tiled roof of the informant. The learned counsel for the petitioners submits that the petitioners are innocent, two of them are family members and no grievous injury is on record to suggest that any sort of grievous
Patna High Court Cr.Misc. No.62152 of 2017 (2) dt.03-01-2018 2/2 injury having been inflicted upon the informant. It is further submitted that the petitioners have a clean antecedent and only on account of village rivalry they have been implicated in the present case.
Having regard to the facts and circumstances of the case, in the event of arrest or surrender within six weeks, the petitioners above named are directed to be released on anticipatory bail on furnishing bonds of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Daudnagar in connection with Daudnagar PS case no. 275 of 2017, subject to the conditions enumerated under Section 438(2) of Code of Criminal Procedure.
