Petitioner seeks regular bail in connection with Sakra P.S. Case No. 82 of 2019 registered for the offence under Section 392 of the I.P.C.
As per the First Information Report the informant was intercepted by the petitioner and other named co-accused persons and they snatched the motorcycle of the informant and also assaulted him with the Butt of the pistol. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case and he has not committed any offence as alleged. He further submits that the fact of the matter is that the informant had sold the motorcycle
Patna High Court CR. MISC. No.39364 of 2021(2) dt.21-01-2022 2/3 bearing registration no. BR06BK-0930 to the brother of the coaccused / Govind Das @ Govind Kumar namely, Neeraj Kumar and subsequently the said motorcycle has been transferred in the name of the brother of the co-accused. He further submits that similarly situated accused Uday Shankar Sharma @ Guddu @ Guddu Thakur, Govind Das @ Pappu Das @ Govin Kumar @ Pappu Kumar and Kanhai @ Kanhai Kumar @ Kanhai Thakur have been granted bail vide Cr. Misc. Nos. 23300 of 2020 , 81243 of 2019 and 15151 of 2020 respectively. The petitioner is in custody since 07/10/2020 and charge sheet has already been submitted.
Regard being had to the submissions made by the parties and taking into consideration the materials available on record, the fact that similarly situated accused persons have been granted bail by different Co-ordinate Benches of this Court, the petitioner is in custody since 07/10/2020 and charge sheet has already been submitted, I am inclined to grant regular bail to the petitioner.
Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-
