Petitioners apprehend their arrest in connection with Patrakar Nagar P.S.Case No. 150 of 2018 registered for the offences punishable under Sections 323, 341 and 307/34 of the Indian Penal Code.
Allegation against petitioner No.1 is of assault by brick and petitioner No.2 is of assault by Fatta to the informant, who is mother of petitioner No.1. It appears that there was property dispute between the parties.
Submission of learned counsel for the petitioners is that they have falsely been implicated in this case due to property dispute in the family.
Heard learned APP and learned counsel for the informant, who has opposed the prayer for anticipatory bail stating
Patna High Court Cr.Misc. No.38579 of 2018 (2) dt.04-07-2018 2/2 that informant has received injury and she was referred to PMCH also.
Having heard both sides and in the facts and circumstances, let the petitioners, above named, surrender within a period of six weeks from the receipt of this order and on their so surrendering they shall be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Sub Judge-X-cum-A.C.J.M., Patna, in connection with Patrakar Nagar P.S.Case No. 150 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and further condition is that petitioners shall not threat the informant and tamper with the evidence, otherwise prosecution will be at liberty to move for cancellation of their bail bonds.
