====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 09-02-2021 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Bakhtiyarpur P.S. Case No. 247 of 2019 for the offence under Section 302/34 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has not committed any offence. In fact, petitioner and the informant happens to be step brother and there is partition dispute between them and on account of same, the petitioner has falsely been implicated in this case. The petitioner is rotting in judicial custody since 05.08.2019.

Learned A.P.P. for the State has opposed the prayer

Patna High Court CR. MISC. No.29394 of 2020(3) dt.09-02-2021 2/2 for bail and submitted that there is direct allegation of opened fire on the chest of the deceased against the petitioner resultantly she died.

Considering the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of this petitioner is rejected. (Arvind Srivastava, J) Brajesh/- U T
