The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections467, 471, 420, 409, 406/34 of the Indian Penal Code.
The prosecution case is that the informant who is District Manager, State Food Corporation, Aurangabad in compliance with the orders of his superiors submitted an enquiry report with reference to the Gunny Bells, lifted for the year 2011-12, 2012-13 and 2013-14 to the Additional Director, General, Police CID who after going through the matter found that fake documents were prepared to cheat the public fund and defalcate the money under the conspiracy made by the accused
Patna High Court CR. MISC. No.35855 of 2019(3) dt.13-08-2019 2/2 persons named therein including the petitioner under the various capacity.
It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in the aforesaid case. He further submits that similarly situated other co-accused have been granted bail by a coordinate Bench of this Court in Cr. Misc. No. 2942 of 2018 on 19.03.2018 and Cr. Misc. No. 24809 of 2018 on 29.05.2018.
In the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Aurangabad in connection with Aurangabad Town Police Station Case No. 308 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
