JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 08-04-2022 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. The petitioner apprehends his arrest in Athmalgola P.S. Case No.213 of 2020, registered for the offences punishable under Sections 147, 148, 149, 323, 324, 307 and 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is further submitted that the FIR was lodged after seven days of the occurrence without any explanation. It is submitted that there is general and omnibus allegation against all accused persons. No specific overt act is alleged against the petitioner. It is also submitted that the petitioner has got one criminal antecedent as stated in paragraph 3 of the bail petition.

Patna High Court CR. MISC. No.39390 of 2021(3) dt.08-04-2022 2/2 Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

Taking into consideration the fact that no specific overt act is alleged against the petitioner, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Barh, District Patna in connection with Athmalgola P.S. Case No.213 of 2020, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
