What the petitioner alleges in the writ petition is the wrong selection of the site or change in the selection of site for construction of Panchayat Sarkar Bhawan in the Gram Panchayat in- question.

Obviously, no personal injury by the act of the State has been caused to the petitioner. Precisely, for this purpose , it appears a public interest litigation was filed vide CWJC No. 14218

Patna High Court CWJC No.22068 of 2013 (2) dt.29-06-2016 2/2 of 2013. A Division Bench of this Court vide order dated 5.8.2013 (Annexure-8) disposed of the application observing that the Court is hardly competent to take such executive decision. Now the present writ petition is filed.

While declining the relief, the application stands disposed of permitting the petitioner to avail the remedy before the appropriate authority/forum in accordance with law. (Kishore Kumar Mandal, J) Shyam/- U
