Learned counsel for the petitioners submits that earlier vide order dated 01.10.2020 the petitioners who are father-in-law and mother-in-law respectively of the deceased have been granted provisional bail after noticing the submissions of learned counsel for the petitioners and while calling for the case diary.

Learned counsel submits that he has instruction to say that the husband of the deceased is already in custody and so far as these two petitioners are concerned, they have been made

Patna High Court CR. MISC. No.25491 of 2020(3) dt.09-11-2020 2/2 accused only because they happen to be the father-in-law and mother-in-law respectively even as there is no specific allegation against the petitioners and no material that the deceased was being tortured by these petitioners. Learned APP for the State has though opposed the prayer for confirmation of bail of the petitioners but is unable to show any independent material against the petitioners suggesting their participation in the alleged occurrence or their involvement in torture of the deceased prior to the alleged occurrence.

In the given facts and circumstances of the case, let the provisional bail granted to the petitioners be confirmed on the same bail bond.
