Heard learned counsel appearing on behalf of the petitioner as well as learned Additional Public Prosecutor appearing for the State.

Let the defect(s) be removed within two weeks of the complete start of the physical Court in normal course. Petitioner who is in custody since 08.10.2020 seeks bail in connection with Ishuyapur P.S. Case No.127 of 2017 registered for offence punishable under Sections 341, 323, 324, 325, 338, 307, 379, 34 IPC.

Prosecution case in brief, is that on 24.06.2017 at about 10.00 PM, when the informant was sleeping with his family members, he got up suddenly and when outside his house he saw his son Ranjeet Singh was standing there and the electric

No.39720 of 2021(2) dt.05-01-2022 2/3 switch was brought down and when he went to the roof to inquire about the matter from his son Ranjeet then Ranjeet Singh along with other accused persons started to thrash the informant and his son Sanjeet with farsa, lathi and rod and after brutal assault by the accused persons, the informant and his son become unconscious and fell down over the ground. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in this case due to malafide intention. He further submits that petitioner was neither arrested on the spot nor any incriminating articles have been recovered from the conscious possession of the petitioner. Learned counsel for the petitioner submits that there is case and counter case.

Learned APP for the State, however, opposes the prayer for grant of bail to the petitioner.

Considering the specific allegation against the petitioner, Ranjeet Singh that he hit over the head over the head of his father with farsa, who is also the informant of the case, causing head injury and fractured his hand, who in course of the said injury died in course of treatment, I am not inclined to release the petitioner on bail.
