JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 21-12-2017 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Chautham P.S.Case No.130 of 2017 registered under Sections 147, 341, 323, 324, 325, 307, 504 and 506 of the Indian Penal Code.

It is stated that there is case and counter case owing to land dispute in which members of both sides sustained injuries and only grievous injury caused to one Prem Shankar was found on the shoulder. In the counter case in the alleged occurrence petitioner no.2 Sanjiv Kumar Singh had also sustained grievous injury and

Patna High Court Cr.Misc. No.60643 of 2017 (2) dt.21-12-2017 2/2 members of the prosecution party have already been granted prearrest bail in the counter case. On the other hand, learned counsel for the State submitted that in the alleged incident four persons sustained injuries and one of the injuries on the person of Meea Devi was found on left eye.

I have heard learned counsel for the parties and perused the record.

Considering the facts and circumstances of the case, in the event of arrest or surrender in the court below within six weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Chautham P.S. Case No.130 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Ashwani Kumar Singh, J) Md.S./- U T
