The petitioner seeks anticipatory bail in connection with Laheriasarai P.S. Case No. 216 of 2016, registered for offences punishable under Sections 419, 420, 467, 468, 471, 474 and 120B of the Indian Penal Code.

Allegation as per FIR against the petitioner is that for declaring the juvenile of his younger brother, a false certificate was produced from the school and later on inquiry, it was found that petitioner has filed false certificate to show the age of his younger brother as juvenile and as such the petitioner has been made accused in this case.

Submission of the learned counsel for the petitioner is

No.40355 of 2018 (2) dt.11-07-2018 2/3 that the petitioner has falsely been implicated in this case and from perusal of the entire case it appears that only fault of petitioner is that he sworn an affidavit in a court of law in the second time and the petitioner has no criminal antecedent.

Learned A.P.P. opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of the order, be released on anticipatory bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each in connection with Laheriasarai P.S. Case No. 216 of 2016, to the satisfaction of learned Chief Judicial Magistrate, Darbhanga, subject to the conditions laid down under Section 438 (2) Cr.P.C. with other that bailors should be local having sufficient immovable property within the jurisdiction of the Court concerned and petitioner shall cooperate in the investigation and shall be present before police as and when required, otherwise prosecution is at liberty to move for cancellation of his bail bonds.
