2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 137 ( 2 ) / 87 of the BNS.

3 . As per F.I.R., informant alleged that on the alleged date and time of occurrence , co-accused Rishal Paswan along with other co-accused persons kidnapped daughter of informant and took cash of Rs. 5,000/- and other gold ornaments.

4. It is submitted on behalf of the petitioner that petitioner is innocent and has committed no offence as alleged. The victim in in her statement recorded under section 183 BNSS supported the prosecution case and stated that it was co-accused Rishal Kumar who kidnapped her. Victim did not say anything

Patna High Court CR. MISC. No.29383 of 2025(3) dt.22-07-2025 2/2 wrong against this petitioner who happens to be uncle of coaccused Rishal Kumar. Petitioner claims clean antecedent. 5 . Learned counsel for the State oppose the bail petition .

6 Considering the nature of injury , clean antecedent of this petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned District & Addl. Sessions Judge VI cum spl. Judge POCSO Vaishali at Hajipur in connection with Mahua P.S. Case No. 1254 of 2024 , subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023 .
