JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 09-07-2015 The Commissioner of Departmental Enquiry is scheduled to superannuate on 31st of July, 2015. Apprehension of the petitioner is that if the enquiry report is not submitted by the said authority, the enquiry of the petitioner will again drag on for years together. Such apprehension is ill founded at this stage because nobody can predict that an officer will leave behind inconclusive work before his superannuation. If this is so, the Court may have occasion to consider what is to be done next. That by itself cannot be a ground for revoking the suspension when the enquiry has already concluded. Writ application is dismissed at this stage.
