JUSTICE MOHIT KUMAR SHAH ORAL ORDER 07-02-2018 Heard the learned counsel for the petitioner and learned counsel for the State.
The petitioner seeks anticipatory bail in connection with Belchi PS case no. 10 of 2017 registered for the offences punishable under Sections 304B, 201 and 34 of the Indian Penal Code.
The allegation against the accused persons is burning the sister of the informant on account of non-fulfillment of demand of dowry.
The learned counsel for the petitioner submits that the case diary would reveal that the victim lady was treated at the hospital and the main culprit is the husband of the victim lady who is already in jail custody and his prayer for regular bail has been
Patna High Court Cr.Misc. No.60069 of 2017 (5) dt.07-02-2018 2/3 rejected by the learned court below. It is further submitted that the petitioner is an aged lady and is not likely to flee away either from the investigation or from the trial.
The learned counsel for the informant has vehemently opposed the prayer for anticipatory bail.
Having regard to the facts and circumstances of the case as also the fact that the husband of the victim lady is already in jail custody, I deem it fit and proper to enlarge the petitioner on anticipatory bail.
Accordingly, in the event of arrest or surrender before the court concerned within a period of six weeks from the date of receipt/production of a copy of the present order, the petitioner above named is directed to be released on anticipatory bail on furnishing bonds of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Patna, District Patna in connection with Belchi PS case no. 10 of 2017, subject to the conditions laid down under Section 438(2) of Code of Criminal Procedure.
It is directed that the petitioner would mark her presence before the Officer Incharge of the concerned Police Station at 10 A.M. on each and every Monday of the month and on
Patna High Court Cr.Misc. No.60069 of 2017 (5) dt.07-02-2018 3/3 account of her failure on two consecutive occasions to mark her attendance, the present privilege of anticipatory bail shall stand cancelled automatically.
