This application for anticipatory bail arises out of Banka (Mahila) P.S. Case No. 70 of 2018 for the offence punishable under Section 498(A) and 494/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. The petitioners are father-in-law, mother-in-law,
Patna High Court CR. MISC. No.29030 of 2019(2) dt.02-05-2019 2/3 brothers and sisters of the husband of the informant. Petitioners No.6 and 7 are wives of petitioners No.3 and 4 respectively. Learned counsel appearing on behalf of the petitioners has submitted that matrimonial discord between the husband and the wife is the main reason leading to registration of the First Information Report and these petitioners have been implicated because of their relationship with the husband. Considering the facts and circumstances of the case and the submissions so advanced on behalf of the petitioners, this application is allowed.
Let the petitioners above named, in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Banka in Banka (Mahila) P.S. Case No. 70 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions,
