JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 01-09-2021 Heard learned Senior Counsel for the petitioner and the learned APP for the State through virtual court proceedings. By order dated 04.08.2021, status report regarding stage of trial was called for, which is kept at Flag 'B'. Perused the report. It is reported by learned Additional District & Sessions Judge-I-cum-Spl. Judge, NDPS Act, Begusarai that the appearance of all the five accused persons completed on 06.02.2021. On 19.02.2021, a petition was filed under Section 226 of Cr.P.C. by the two co-accused and at present, this case is pending for hearing on the aforesaid petition. It is also reported that due to prevailing Covid-19 pandemic situation, the court is running on virtual mode. The next date in this case is fixed on 18.08.2021.

Patna High Court CR. MISC. No.40329 of 2021(3) dt.01-09-2021 2/2 Considering the report, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of the petitioner is rejected in connection with Barauni (F.C.I.) P.S. Case No.280 of 2019.

However, the trial court is directed to expedite the trial and conclude it preferably within a period of six months. Both the parties shall co-operate in early disposal of the trial. At the same time, the Superintendent of Police, Begusarai is directed to ensure the production of the witnesses in the trial court on the date fixed so that the trial must be concluded within a period of six months.
