The petitioner is languishing in custody in a case registered for the offences punishable under Section 392 of the Indian Penal Code and Section 27 of the Arms Act. It is alleged that C.S.P centre of the informant was robbed by four unknown miscreants and cash, ATM Card, Pan Card, Aadhar Card etc were taken away.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner is not named in the F.I.R. Nothing has been recovered from the conscious possession of the petitioner. The petitioner was not apprehended from

The name of petitioner sprang up in this case on the basis of confessional statement of co-accused Raju Chaudhary who has already been granted bail vide order dated 28.07.2023, passed in Cr. Misc. No. 42568 of 2023 by this Court. Moreover, the petitioner is languishing in custody since 06.11.2023.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Vaishali at Hajipur in connection with Rajapakar P.S. Case No. 50 of 2023.
