Petitioner apprehends arrest in connection with Complaint Case No. 1957 of 2013 registered under Sections498A of the Indian Penal Code and 4 of the Dowry Prohibition Act.
Learned counsel for the petitioner submits that petitioner, who happens to be husband, is innocent and has falsely been implicated in this case. Further submission is that petitioner is ready to keep his wife.
Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner with contention that
Patna High Court Cr.Misc. No.52898 of 2016 (5) dt.30-08-2017 2/2 petitioner is husband, who is fully responsible for the alleged occurrence. On perusal of Mediation Proceeding Case No. 242 of 2017, it appears that in spite of best and sincere efforts, the mediation could not succeed.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the petitioner, I do not feel inclined to grant the privilege of anticipatory bail to the petitioner. His prayer for anticipatory bail is, therefore, rejected. (Arvind Srivastava, J) Shailendra/- U T
