For the Petitioner/s : Mr. Ram Sewak Prasad, Adv. For the Respondent/s : Mr. Ram Balak Mahto, AG ====================================================== CORAM: HONOURABLE MR. JUSTICE MIHIR KUMAR JHA ORAL ORDER 17-07-2015 Heard learned counsel for the parties.
This writ application of the petitioner, a Panchayat teacher, against an order of transfer passed by the Panchayat Secretary, is of-course premature because he had/has a statutory alternative remedy before the competent District Teacher Employment Appellate Authority in terms of Rule 18 of the Bihar Panchayat Teachers Appointment Rules, 2006/2012. Admittedly the petitioner has not moved the Authority before filing of this writ application.
Patna High Court CWJC No.7514 of 2015 (2) dt.17-07-2015 That being so, this application is wholly misconceived and ill-advised.
It is, accordingly, dismissed.
