The petitioners apprehend their arrest in connection with Brahampur P.S. Case No. 139 of 2016, registered under Sections 409 and 420 of the Indian Penal Code, pending in the court of the Chief Judicial Magistrate, Buxar. The accusation is that in the light of the order of the Patna High Court vigilance enquiry was started regarding the illegalities and irregularities committed in the appointment of Panchayat teachers. Accordingly, through letter No. 05-2522, dated 12.11.2015 and letter No. 2149, dated 20.11.2015, the document regarding the appointment of Panchayat teachers since

Patna High Court Cr.Misc. No.55728 of 2016 (18) dt.07-09-2017 2/2 2003 were called for by the District Programme Officer, Buxar from different panchayats including the Gaighat, Gahauna, Pokhraha, Bakrapur and Barathi to which the petitioners were Panchayat Secretaries, but the same were not supplied by them. Having considered the facts and circumstances of the case and the nature of allegation against the petitioners, I am not inclined to grant anticipatory bail to the petitioners. Accordingly, their prayer for grant of anticipatory bail stands rejected. The petitioners are directed to surrender before the trail Court within six weeks and pray for regular bail, which would be considered by the trial Court in accordance with law without being prejudiced by the order of this Court.
