The petitioner seeks bail in Lakhnour P.S. Case No.149 of 2016 registered under Sections 323, 333, 353 and other Sections of the Indian Penal Code.

Prayer for bail of the petitioner was earlier rejected vide order dated 01.05.2017 passed in Cr. Misc. No.10920 of 2017.

Learned counsel for the petitioner submits that occurrence is said to have taken place in front of Circle Officer and S.H.O. Had such occurrence taken place, the S.H.O. would have arrested the petitioner but it appears that earlier anticipatory bail petition of the petitioner was rejected after considering all the materials collected during the course of investigation as well as

Patna High Court Cr.Misc. No.2162 of 2018 (2) dt.21-02-2018 after perusal of the F.I.R. The petitioner and other accused persons are alleged to have assaulted the electrical engineer while he tried to redress the grievance of the petitioner. It is a sheer act of vandalism on the part of the villagers. The petitioner did not surrender even after rejection of his anticipatory bail petition and filed another petition for grant of bail.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
