JUSTICE ANIL KUMAR SINHA ORAL ORDER 18-04-2023 The present writ application has been filed by the petitioner for grant of graduate trained pay scale w.e.f 22.07.2011 and promotion on the post of Headmaster w.e.f 05.09.2013.
Learned counsel for the State, referring to Bihar Prarambhik Vidyalaya Shikshak Pronnati Niyamavali 2011, submits that there is a provision for appeal before Regional Deputy Director of the area and the petitioner may be relegated in appeal before the concerned authority for redressal of his grievance.
Patna High Court CWJC No.6757 of 2015(9) dt.18-04-2023 2/2 Taking into consideration Rule-18 of the Bihar Prarambhik Vidyalaya Shikshak Pronnati Niyamavali 2011, this writ application is disposed of with liberty to the petitioner to raise his grievance before the appellate authority under the aforesaid Rules within a period of 30 days. If such an appeal is filed by the petitioner along with condonation of delay petition, the concerned authority shall consider the same in accordance with law.
