====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 08-05-2023 Heard Mr. Sunil Kumar, learned counsel appearing on behalf of the petitioner and Mr. Kalyan Shankar, learned A.P.P. for the State.

The petitioner apprehends her arrest in connection with Sahiyara P.S. Case No. 166 of 2021, registered under Sections 363 and 366 of the Indian Penal Code and Section 8 of the POCSO Act.

The prosecution case, in brief, is that the minor daughter of the informant went missing upon search it was informed that accused persons named in the F.I.R., including the petitioner, had kidnapped her minor daughter. Learned counsel appearing on behalf of the petitioner submitted that the petitioner is sister of co-accused Sonu Kumar. He further submitted that the daughter of the informant and co-accused Sonu Kumar are leading their happy

Learned A.P.P. for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioner. Considering the fact that no allegation has been made against the petitioner that she had participated in kidnapping of daughter of informant. Let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J-VI-cum-Special Judge, POCSO, Sitamarhi in connection with Sahiyara P.S. Case No. 166 of 2021, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Purnendu Singh, J) manish/- U T
