JUSTICE MADHURESH PRASAD ORAL JUDGMENT Date : 05-03-2019 Attention of the Court has been drawn to office order (Annexure 9 of the writ petition). It is contended that in the said office order dated 15.01.2013 reference is made to letter dated 31.12.2013 bearing memo number 2889 issued by the Director, Mass Education- cum- Joint Secretary, Bihar. As per letter dated
Patna High Court CWJC No.6158 of 2015 dt.05-03-2019 2/2 31.12.2012 decision on claim for payment for the period of retrenchment between 2001 to 2006 is pending before the Apex Court.
It is jointly submitted by the parties that the entitlement of the petitioner to claim benefits for the period 2001-2010 will be subject to the outcome of the proceedings pending before the Hon'ble Supreme Court in this respect.
In view of the said situation, no order needs to be passed in the instant writ petition. If the decision of the Apex Court extends any benefit to the employees and petitioner is similarly situated, it is needless to say that the petitioner will get the same benefits.
Writ petition is disposed off.
