The petitioners seek pre-arrest bail in connection with Makhdumpur P.S.Case No. 111 of 2017 registered under Sections 147, 148, 149, 341, 323, 307, 379, 504 and 506 of the Indian Penal Code.
It is submitted by the learned counsel for the petitioners that similarly circumstanced co-accused Rakesh Kumar @ Rakesh Yadav @ Rajesh Kumar, Akhilesh Yadav, Rajeshwar Yadav, Chhoti Yadav, Funtus Bind, Saryun Bind @ Sarjug Bind, Kaypee Bind @ K.P. Bind, Guddu Bind, Shivpati Bind, Ajay Bind, Butu Bind, Lalbabu Bind, Ashok Yadav and Shailesh Yadav
Patna High Court Cr.Misc. No.60803 of 2017 (2) dt.21-12-2017 2/2 have already been granted pre-arrest bail by different Benches of this Court, vide orders dated 16.08.2017 and 03.10.2017 passed in Cr.Misc. Nos. 34503 of 2017 and 46420 of 2017. Learned counsel appearing for the State does not dispute the aforesaid contention made by the learned counsel for the petitioners.
Regard being had to the reasons assigned in the aforesaid orders, in the event of arrest or surrender before the court below within four weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Jehanabad in connection with Makhdumpur P.S.Case No. 111 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
