====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 23-05-2024 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in connection with Jhajha P.S. Case No.293 of 2018 instituted under Sections 304(B), 120(B) and 34 of the Indian Penal Code.

3. As per the prosecution case, all the accused persons including the petitioners committed the murder of the daughter of the informant for dowry.

4. Learned counsel for the petitioners submits that

Patna High Court CR. MISC. No. 33629 of 2024(2) dt.23-05-2024 2/3 petitioners are innocent and have been falsely implicated in this case on the basis of suspicion. He further submits that the petitioner no.1 is brother-in-law (Bhaisur), petitioner no.2 is Gotni, petitioner no.3 is brother-in-law (Nandoshi) and petitioner no.4 is married sister-in-law (Nanad) of the deceased. He further submits that petitioners were living separately from the victim and his husband. Learned counsel submits that other co-accused persons including the husband are on bail and facing the trial in which prosecution witnesses have not supported the case of prosecution. He further submits that petitioners have no criminal antecedent and they undertake to cooperate in the investigation and trial.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount to each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in connection with Jhajha P.S. Case No.293 of 2018, subject to the conditions laid
