JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 22-01-2016 The Court has very carefully gone through the so called inspection report of Narayan College of Law, Jamuhar submitted by a team of three members whose names and designations have been indicated therein. From a dispassionate reading of the said report, it seems that the inspection team does not even understand the basic requirements which are needed for setting up of a law college of repute and standing. If they wanted to recommend opening of a teaching shop, it is another issue. For whose benefit such an inspection report has been prepared and submitted to the University can only be appreciated by the University authorities. The report, therefore, does not inspire adequate confidence in this Court nor do the infrastructure which has been indicated in the said report.

2. Even otherwise, since the report only talks in terms of

Patna High Court CWJC No.6228 of 2015 dt.22-01-2016 2 / 2 assurance which has been given by the management to remove different inadequacies in different fronts and quite sometime has elapsed since those assurances were given, time has come when a fresh inspection may be required to be made and the difference between the previous facilities and infrastructure and what has been done after the inspection till now can also establish the bona fide of the authorities interested in setting up of such an institution.

3. The Court, therefore, would like to direct the ViceChancellor of Veer Kunwar Singh University, Ara to set up yet another committee for a fresh look on the infrastructure. The Vice-Chancellor must ensure that none of the committee members are pliable and will succumb to any kind of temptation or any kind of pressure applied upon them in giving a dispassionate report with regard to the state of affairs of the college in question.

4. Once such a report is submitted, the University may have an occasion to consider the question of grant of affiliation.

5. Let a decision in this regard be taken within a period of four months from the date of production of a copy of this order.

6. Writ application stands disposed of with the above direction.
