The petitioner is apprehending his arrest in a case registered under Section 498A of the Indian Penal Code and 3⁄4 of Dowry Prohibition Act.
The matter was referred to the Patna High Court, Mediation Centre vide order dated 6.4.2017. As per the report of the Mediator, the matter has already been settled between the parties. The report submitted by the Mediator is as follows : "Parties are present with their respective lawyer. In the name of permanent settlement Rs.50,000/- was the amount as per consent of both parties, Rs.25,000/-
Patna High Court Cr.Misc. No.1464 of 2017(8) dt.22-09-2017 2/2 (Twenty five thousand rupees only) cash the opposite party No.2 had received last time on 26.07.2017 and today rest 25,000/- also received by her given by husband.
Now the parties are agreed to withdraw their cases filed in court below. The parties are also agreed for mutual divorce and for that they will file the joint petition for divorce before the court below within a month from today.
Thus the mediation succeeds."
Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Pupri, District Sitamarhi in connection with Trial No.220 of 2016 arising out of Complaint case No. C1-525 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
