2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 383 , 323 , 354, 420, 504, 506 and 34 of the Indian Penal Code and later on Section 387 of IPC .

3. As per the prosecution case, allegation against this petitioner is that he illegally sold the purchased land of the

Patna High Court CR. MISC. No.31667 of 2024(2) dt.21-05-2024 2/3 informant to some other persons who are forcibly and illegally making construction there .

It is submitted on behalf of the petitioner that this petitioner and informant are legal heirs of late Sureshwar Pratap Singh who has 4 sons l, late Nawal Kishor Singh, Narendar Kishor Singh, late Devendra Kishor Singh and Virendra Singh @ Tunna Singh (petitioner), the informant Rani Sinha is the adopted daughter of late Devendra Kishore Singh and thus petitioner is agnate of the informant parties. Moreover, there is admitted land dispute between the parties for which titile suit No. 131 of 2024 is pending before the learned Sub Judge, Motihari, due to which the present false and concocted case has been lodged against this petitioner by the informant party.

5. Learned counsel for the State opposes the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st class, Motihari in connection
