The petitioner apprehends his arrest in a case registered for the offences punishable under Section 341, 342, 323, 307, 365 & 363/34 of the Indian Penal Code. Petitioner along with five other accused persons are said to have kidnapped the informant from Patna by gagging his mouth and after administering liquor left free in Buxar on the following day.

Learned counsel for the petitioner submitted that no such occurrence as alleged ever took place. The petitioner is quite innocent and has been falsely implicated in this case due to property dispute between the informant and some other accused persons and petitioner happens to be the friend of the accused persons. No.28164 of 2019(3) dt.02-05-2019 2/2 petitioner in Buxar but no F.I.R. was lodged at Buxar rather at Patna after inordinate delay of 21 days without assigning any explanation for the said delay. The allegation levelled against the petitioner is not specific rather general and omnibus in nature.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-X, Patna in connection with Patrakar Nagar P.S. Case No. 286 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Prakash Chandra Jaiswal, J) Trivedi/- U T
