JUSTICE SANJAY PRIYA ORAL ORDER 25-01-2018 Heard learned counsel for the petitioner and learned APP for the State as well as counsel for the Informant. Petitioner apprehends his arrest in Hajipur Mahila P.S. Case No.17 of 2016 instituted for the offence under Section(s) 498-A, 307/34 Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.
It has been submitted that earlier matter was sent to Mediation Centre where settlement has been arrived at between the parties. Memorandum of agreement is attached with the report of the Mediator. As per agreement, petitioner has already paid rupees seven lac as alimony amount to the Complainant. In such circumstances, petitioner is directed to surrender before the Sub-Divisional Judicial Magistrate,
Patna High Court Cr.Misc. No.55305 of 2016 (10) dt.25-01-2018 2/2 Vaishali at Hajipur, in connection with Hajipur Mahila P.S. Case No.17 of 2016 within a period of four weeks from the date of receipt of a copy of this order along with copy of the memorandum of agreement and the Court below on being satisfied that entire amount of alimony has been paid to the informant will release the petitioner on anticipatory bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each subject to the conditions as laid down under Section 438(2) Cr. P. C.
