The petitioners apprehend their arrest in Mahua P.S. Case No. 256 of 2016 registered under Section 353 and other sections of the Indian Penal Code.
The police officer alleged that mother-in-law of former Mukhiya, Savita Devi, was shot at in the night of 27/28.06.2016 and for that about 250 people under the leadership of former Mukhiya, Savita Devi, came and blocked the road
Patna High Court Cr.Misc. No.56015 of 2017 (2) dt.13-12-2017 causing inconvenience to common people. They also damaged the vehicles.
The learned counsel for the petitioners submits that the petitioners are of course named in the first information report, but, no specific allegation is made against the petitioners, Savita Devi, Mukhiya of the Gram Panchayat, who is named at serial no. 1 and it is alleged that under her leadership mob blocked the road has already been granted anticipatory bail vide order passed in Cr. Misc. No. 40355 of 2016.
Considering the facts that there is no specific allegation against the petitioners and similarly situated co-accused, namely, Savita Devi, has already been granted anticipatory bail, the petitioners, in the event of their arrest or surrender, within four weeks from the date of receipt of this order, are directed to be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Mahua P.S. Case No. 256 of 2016 to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
