The petitioner apprehends his arrest in Dulhin Bazar P.S. Case No.72 of 2018 registered under Sections 376, 511 and other Sections of the Indian Penal Code.

The informant alleged that while she was cleaning her courtyard, the petitioner entered into courtyard and made an abortive attempt to commit rape with her. Her cousin sister came and saved the informant. Thereafter, the petitioner fled away. When the uncle of the informant went to complain, the petitioner assaulted him and also assaulted the informant. The learned counsel for the petitioner submits that there is a tailoring shop of the petitioner by the side of the house

Patna High Court Cr.Misc. No.39250 of 2018 (2) dt.09-07-2018 of the informant. The informant got some cloths and some money was lying due. When the petitioner demanded the same, the informant lodged the case making false allegation but it appears on the face of the allegation that it was the petitioner who entered into the house of the informant in the early morning while she was alone and made attempt to commit rape with her. Considering the facts and nature of allegation, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
