JUSTICE SUDHIR SINGH ORAL ORDER 06-07-2022 Heard learned counsel for the petitioners and the State. Learned counsel for the petitioners is directed to remove the defect(s), as pointed out by the office, within a period of four weeks.
The present application has been filed for modification of the order dated 28-04-2022 passed in Cr. Misc. No. 54844 of 2021 by which the petitioners were granted anticipatory bail in connection with Magadh Medical P.S. Case No. 34 of 2021. It is submitted on behalf of the petitioners that in the prayer portion of main petition of Cr. Misc. No. 54844 of 2021,
Patna High Court CR. MISC. No.33432 of 2022(2) dt.06-07-2022 2/2 "learned District & Sessions Judge, Gaya" has wrongly been mentioned in place of "learned Additional Chief Judicial Magistrate-IV, Gaya" and due to that, same mistake occurred in the order dated 28-04-2022 passed in Cr. Misc. No. 54844 of 2021.
Considering the submissions made on behalf of the petitioners, the order dated 28-04-2022 passed in Cr. Misc. No. 54844 of 2021 is modified to the extent that "learned District & Sessions Judge, Gaya" mentioned in the last paragraph of the order be read as "learned Additional Chief Judicial Magistrate-IV, Gaya". The period of surrender of the petitioners in the court below is extended for a further period of six weeks from the date of receipt/production of a copy of this order. The rest of the conditions shall remain the same as mentioned in the order dated 28-04-2022 passed in Cr. Misc. No. 54844 of 2021. The order dated 28-04-2022 passed in Cr. Misc. No. 54844 of 2021 is modified to the extent as indicated above. The modification application is, accordingly, disposed of. (Sudhir Singh, J) A.K.V.//- U T
