1. Heard learned counsel for the parties.

2. The petitioner has renewed his prayer for bail in connection with Begusarai Town (Lohiya Nagar O.P.) P.S. Case no. 274 of 2020 registered under sections 302 and 34 of the Indian Penal Code and sections 25(1-B)(a), 26 and 27 of the Arms Act.

3. The earlier application for bail of the petitioner was rejected vide order dated 9.5.2022 (Annexure-1) passed in Cr. Misc. no.55242 of 2021.

4. As per the prosecution case, on the three accused persons who were on a motorcycle on being stopped by the informant and another police personnel for checking, it is stated that they entered into a scuffle with the informant. One of the accused managed to free himself and taking out a country made

Patna High Court CR. MISC. No.30745 of 2023(3) dt.28-06-2023 2/2 pistol shot at and killed Rajwardhan Ranjan, a police personnel, who died on the spot. It is further stated that all the three accused persons were caught at the place of occurrence including the accused who had shot the police personnel.

5. Learned counsel for the petitioner submits that the petitioner is in custody since 31.5.2020. He is coopering in the trial in the learned trial Court and not even charge has been framed.

6. Heard learned A.P.P. for the State.

7. A report was called for from the learned trial Court. As per the report received contained in letter dated 17.5.2023 from the Additional District and Sessions Judge-IV, Begusarai, the case is running for appearance of the accused.

8. Having heard learned counsel for the parties and taking into consideration the allegation against the petitioner being of having shot and killed the police personnel and the petitioner having been caught at the place of occurrence itself, the Court is not inclined to enlarge the petitioner on bail and the application is rejected.
