Heard Shri N.A. Shamsi, learned counsel for the petitioner and Shri Ajeet Kumar, learned A.P.P. appearing on behalf of the State.

Prosecution case, in brief, is that the informant is a minor girl, aged about 17 years, and was trapped in love affairs with the petitioner who promised to marry with her and, on the said promise, the petitioner sexually exploited her for last three years.

Learned counsel appearing on behalf of the petitioner submits that the victim-girl has filed a petition dated 27.02.2021 before the court below that the parties have entered into a compromise and subsequent to that she has also filed one

Patna High Court CR. MISC. No.39125 of 2021(2) dt.04-01-2022 2/2 petition dated 01.03.2021 wherein she stated that since she has entered into a compromise she does not want to pursue further with the case. It has further been stated by learned counsel that though above two applications filed on behalf of the petitioner was kept on the record, the same was not considered by the court below.

The court below is directed to release the petitioner on bail upon furnishing bail bond of Rs. 20,000/- (Rupees twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VI-cumSpecial Judge, Banka in connection with Dhoraiya P.S. Case No. 358 of 2020 (Spl. Case No. 01 of 2021), with condition that the victim girl shall live alongwith her natural parents till she attains the age of majority and after obtaining the joint compromise petition filed on behalf of the petitioner and the victim girl alongwith witnesses who shall be the parents of the petitioner as well as the victim-girl. In case either of the parties refuses to put their signature on such affidavit or refuses to compromise, the bail bond of the petitioner shall be rejected. (Purnendu Singh, J) Kundan/- U T
