The petitioners apprehend their arrest in a case registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code. As per the prosecution case, petitioner no. 1 assaulted the brother of informant and there is general and omnibus allegation against petitioner no. 2.

It is submitted that due to land dispute between the parties free fight took place in which both sides sustained injuries. Both parties are agnates. Injuries sustained by the injured are simple in nature. Petitioners claim clean antecedents.

No.30837 of 2022(2) dt.29-09-2022 2/2 Considering the fact that there is land dispute between the parties and petitioners claims clean antecedents, the petitioners above-named, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Banka in connection with Shambhuganj P.S. Case No. 254 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
