The petitioner seeks regular bail in connection with Bettiah Town P.S. Case No. 61 of 2023 registered for the offence punishable under Sections 399, 401, 413, 414, 420, 467, 468 and 120 (B) of the Indian Penal Code.

As per prosecution case, F.I.R. has been lodged against six named accused persons, against whom allegation is that they were planning for theft of vehicles and upon a secret information, a raid was conducted by the police in which the petitioner alongwith other co-accused persons were apprehended.

Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.30206 of 2023(2) dt.12-06-2023 2/2 recovered mobile was his own mobile and there is no criminal antecedent against the petitioner. Petitioner is innocent and has committed no offence. He further submits that the petitioner is in jail custody since 29.01.2023. The other similarly situated co-accused named Tahid Ansari @ Tahir Ansari, has been granted regular bail by this Court vide order dated 07.06.2023 in Cr. Misc. No. 28764 of 2023.

Learned APP appearing for the State has opposed the prayer for regular bail of the petitioner.

Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bettiah Town P.S. Case No. 61 of 2023.
