The petitioner apprehends his arrest in Narhat P.S. Case No.89 of 2016 registered under Sections 379, 188, 307, 353, 34 of the Indian Penal Code and 4/40 of the Bihar Miner and Mineral Concession Rules.
The informant found tractors loaded with sand and alleged that the owner and driver of the tractors were committing illegal mining without having any license. The informant also recovered two motorcycles from the place of occurrence. The learned counsel for the petitioner submits that the petitioner is not at all concerned with the sand and the tractors recovered from the place of occurrence. Petitioner is the owner of a motorcycle bearing registration No.BR-27C-2348 and the same
Patna High Court Cr.Misc. No.40097 of 2018 (2) dt.12-07-2018 motorcycle was also recovered by the side of the river and on such basis, the petitioner has been made accused.
Considering the facts aforesaid and the nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. V, Nawadah in connection with Narhat P.S. Case No.89 of 2016, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
