Petitioners apprehend arrest in connection with Ranitalab P.S. Case No. 274 of 2020 registered for the offence punishable under sections 341, 323, 324, 307, 379, 504/34 of the Indian Penal Code.

Learned counsel appearing for the petitioners submits that petitioners have committed no offence as alleged in the first information report and they have been falsely implicated in this case. The informant and the petitioners are relatives. Injuries sustained have been found to be simple in nature. Petitioners have no criminal antecedent.

Patna High Court CR. MISC. No.39253 of 2021(2) dt.25-02-2022 2/2 Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that there is specific allegation of giving knife blow on petitioner no. 1, and as such, he does not deserve to be granted the privilege of anticiaptory bail.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner nos. 2, 3 and 4, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing personal bond to the satisfaction of Additional Chief Judicial Magistrate, II, Danapur in connection with Ranitalab P.S. Case No. 274 of 2020 subject to the conditions laid down under section 438(2) Cr.P.C.

So far as petitioner no. 1, Umesh Dome @ Umesh Ram is concerned, considering the nature of allegations levelled which is supported by the injuries sustained, this Court is not inclined to grant him the privilege of anticipatory bail.
