Having regard to the fact that the opposite parties have already made the final gradation list in terms of the direction given by this Court in the case of Ram Nath Singh & Ors. v. the State of Bihar & Ors. reported in 2009(3) PLJR 384 and thereafter had also considered the case of the petitioner for grant of B.A. Trained Pay Scale, but have found him ineligible on account of pendency of the departmental proceeding as well as criminal case for which he was also placed under suspension by an

Patna High Court MJC No.6477 of 2013 (3) dt.01-05-2015 2/2 order dated 27.01.2011on the ground of embezzlement of Rs. 10,60,000/-, this Court does not find any reason now to continue with this contempt application because in the order in the connected writ petition, the direction of this Court was confined only to ensure preparation of gradation list and consider the case of the petitioner for promotion in the B.A. Trained pay scale and that has been already done.

3. That being so, this contempt application has become infructuous and is, accordingly, dismissed.
